Agency(New Delhi): Delhi Police have submitted an Action Taken Report (ATR) to Tis Hazari Court, stating that no offense has been established in Delhi concerning allegations of hate speech made by Congress leader Mallikarjun Kharge. The allegations stemmed from comments Kharge made at an election rally in Naregal, Karnataka, in April 2023.
The complaint against Kharge was initially lodged by advocate Ravinder Gupta, who sought the registration of an FIR against the Congress leader for his remarks. Gupta, represented by advocate Gagan Gandhi, claimed that Kharge’s speech at the rally included derogatory comments aimed at the BJP-RSS, which he later clarified were not directed at Prime Minister Narendra Modi but at the BJP and RSS ideologies, comparing them to a “poisonous snake.”
Despite the complaint and a subsequent legal notice, Delhi Police’s investigation concluded that the alleged incident occurred outside their jurisdiction, specifically in Karnataka, and therefore no actionable offense occurred within Delhi. This finding was detailed in their report to the court.
Metropolitan Magistrate Chatinder Singh has scheduled a follow-up hearing for May 24, where the Investigation Officer (IO) is expected to further clarify the situation. This development marks a significant point in the case, potentially influencing the legal approach to jurisdictional claims in political speech-related complaints.
