Agency (New Delhi): The Supreme Court granted anticipatory bail to Umar Ansari, son of the late gangster-politician Mukhtar Ansari, on Monday. He is accused of violating the model code of conduct during the 2022 Uttar Pradesh assembly elections. A bench comprising Justices Hrishikesh Roy and PK Mishra instructed Ansari to appear before the trial court, which will grant him bail.
During the hearing, senior advocate Garima Prashad, representing the Uttar Pradesh government, emphasized that Ansari had not appeared in court and argued that he should not receive anticipatory bail. Prashad stated that Ansari had incited people during a public meeting and urged the court to have him seek regular bail instead.
However, senior advocate Kapil Sibal, representing Ansari, argued that his client had appeared in court and posted bonds. Sibal maintained that Ansari had not made any inflammatory statements from the stage during the incident in question.
The bench ultimately decided to grant anticipatory bail to Ansari, provided that he appeared before the trial court and furnished the required bail bonds. The court had previously offered Ansari protection from arrest in January.
This ruling overturns a December 19 decision by the Allahabad High Court, which denied Ansari’s request for anticipatory bail. The High Court claimed that the circumstances warranted an offense against Ansari. An FIR filed on March 4, 2022, accused Umar and his brother Abbas Ansari of delivering provocative speeches at a public rally in Mau district.
Mukhtar Ansari, a former legislator, passed away on March 28 due to cardiac arrest at a hospital in Banda, Uttar Pradesh.
