Agency(New Delhi): The Rouse Avenue Court in New Delhi has dismissed the interim bail application of BRS MLC K Kavitha, stating that the evidence presented indicates her prima facie involvement in the alleged offenses and actions to destroy evidence. The decision was made by Special Judge Kaveri Baweja who also noted Kavitha’s attempts to influence witnesses.
Kavitha, who is currently in judicial custody following interrogation by the Enforcement Directorate (ED), had sought interim bail citing the school examinations of her minor son as the basis for her request. However, Judge Baweja refuted this reasoning, suggesting that the presence of other family members should suffice to support her son during this period.
“The material placed prima facie points towards her active involvement in the commission of the alleged offenses as also towards her deliberate act of destroying evidence,” stated Judge Baweja in the court’s ruling. She emphasized that Kavitha, being a well-educated and prominent figure, does not fit the profile of a vulnerable individual unfairly targeted in the case.
Further, the court dismissed the notion that Kavitha’s presence was crucial for her son’s exam preparations, pointing out that her older son is currently studying abroad in Spain without parental supervision. This comparison was used to challenge the necessity of her physical presence for her younger son’s academic needs.
The court also highlighted the potential for digital communication to mitigate the absence of family members, reinforcing the view that physical presence is not indispensable. Additionally, it was noted that Kavitha’s sisters could provide necessary familial support during her custody.
The court’s decision comes ahead of the scheduled hearing for Kavitha’s regular bail plea, now postponed to April 16. The case continues to develop as legal arguments and proceedings unfold.
