New Delhi (Agency): In India’s capital city, New Delhi, on Friday, the Supreme Court, the highest court in the country, said no to a request made in 2019. A little child, only two years old, had asked for an investigation by the CBI or SIT. This was about claims of a big and well-planned scam related to kidney transplants. This scam involved big hospitals in many states. But the court said it cannot solve every problem.
Two judges, named S K Kaul and Sudhanshu Dhulia, were hearing this case. They said the court can’t be a solution for everything. They said these are issues that the police and the people who run the country have to handle.
The Supreme Court had asked for responses from the central government and others in August 2019. This was about the request of the little boy, who was only 23 months old then. He had come to the court with his mother. The boy has a condition called West syndrome. This condition causes children to have seizures and impacts their thinking and development. He became mentally disabled because of this when he was born in a private hospital.
During the hearing on Friday, a lawyer named Sachin Jain represented the little boy. He told the judges about five recent claims of a kidney scam in 2023. He also mentioned a report from January 2013. This report was by a retired judge named J S Verma. The report talked about children being forced to work, being sexually abused, and being victims of illegal trade of human organs.
The judges said they don’t want to hear this request anymore. But they asked the central government and others to look into the issue. They should do this especially keeping in mind the report by Judge J S Verma, the judges said.
During the hearing, the judges asked if the Supreme Court should have a system for everything and every department. Jain said that these scams have connections across states and even countries. So, a central agency should be given the task to investigate them.
But the judges said these are issues for the administration. There is a system of police and people who run the country to handle it. “We can’t take the responsibility of everything and start doing it here,” the judges said.
They said that if something isn’t working in a particular incident, the court looks into it and gives its order. The court cannot be a solution for everything that is wrong in the country, they said.
