New Delhi: The Supreme Court on Friday refused to entertain a petition filed by Prashant Kishor’s Jan Suraaj party seeking to annul the 2025 Bihar Assembly election results, alleging that the ruling government “illegally distributed ₹15,600 crore in cash to voters.”

A bench headed by Chief Justice Surya Kant said the petitioners are free to approach the High Court but declined to intervene at the apex court level. “We cannot issue a notice like this. There is a procedure. Because you lost the elections, you want to set aside the entire result. Even the issue raised regarding welfare policies cannot be entertained by this court unless it is brought by a public-spirited person. If this party were to come to power, they could do the same thing,” CJI Kant remarked during the hearing.

The petition alleged that the Bihar government, led by Chief Minister Nitish Kumar, manipulated the Mukhyamantri Mahila Rojgar Yojana scheme by adding additional beneficiaries just before the elections and distributing ₹10,000 under the Direct Benefit Transfer (DBT) program. Jan Suraaj claimed this constituted corrupt practice aimed at influencing voters.

The petition further stated that the scheme, introduced by a Cabinet decision rather than through legislative approval, violated Article 267 of the Constitution, as funds were withdrawn from the state’s Contingency Fund instead of being part of the regular budget.

In the 2025 Assembly elections, the ruling NDA secured a three-fourths majority, winning 202 out of 243 seats—the second time the alliance crossed the 200-mark, after 2010. The Mahagathbandhan managed only 35 seats, with Rashtriya Janata Dal winning 25, Congress 6, CPI(ML) Liberation 2, Indian Inclusive Party 1, and CPI(M) 1. Other parties, including AIMIM and BSP, won 5 and 1 seat respectively.
