New Delhi (Agency): The Delhi High Court has approved the hospital admission of Amit Arora, the Director of Buddy Retail Pvt. Ltd., who is an accused in the excise policy case. Arora recently underwent Laparoscopic Sleeve Gastrectomy and will be admitted for post-operative care.
Justice Dinesh Kumar Sharma noted that the jail facilities might lack the required medical infrastructure to properly care for Arora’s medical condition. Vikas Pahwa, a Senior Advocate representing Arora, argued for interim bail lasting three months due to his client’s various health issues. Arora was discharged from Fortis Memorial Research Institute on August 31 after his surgery.
On the other side, Zohaib Hossain, Special Counsel for the Directorate of Enforcement (ED), pointed out that Arora had already spent about 164 days out of jail. This time included both his interim bail and hospital stays. Hossain also mentioned that the surgery was elective.
In its decision, the court emphasized that everyone with a medical condition deserves effective and suitable medical care. At the same time, the court warned that interim bail should not be used as a loophole to avoid legal consequences, particularly referring to Section 45 of the relevant law.
The bench further stressed that detention during an investigation or trial should not serve as a form of punishment. In line with this, the court stated that sick individuals must be given proper medical treatment to enable them to face trial in accordance with the law.
