High Court Approves Indefinite Fast for Tamil Language

Madras High Court grants permission for an indefinite fast demanding Tamil as the official language in High Court proceedings.

Agency (Chennai): In a significant development, the Madras High Court, led by Justice N. Anand Venkatesh, has resolved the writ petition No.34716 of 2023 filed by G. Bhagavath Singh. The petitioner challenged the rejection of his request to conduct an indefinite fast, advocating for Tamil to be recognized as an official language in the High Court’s proceedings.

The court’s decision comes after several hearings where alternative venues were discussed. The petitioner initially sought permission for a fast near the Marina Beach or the Collector Office in Chennai. However, after deliberations and suggestions from the government, the Rajarathinam Stadium near Marshalls Road was selected as the venue for the protest, slated to commence on 28.02.2024.

The court’s order emphasizes that the protest, aimed at advocating for Tamil under Article 348(2) of the Constitution of India and Section 7 of the Official Languages Act, 1963, must be conducted peacefully without causing any law and order issues or disturbing public and vehicular movement. The petitioner is directed to furnish a list of participants and ensure cooperation with the police to maintain order.

Justice Venkatesh highlighted the legitimacy of the cause, recognizing the cultural significance of the demand to use Tamil in High Court proceedings. The court allowed the protest with specific conditions, ensuring the peaceful expression of the petitioner’s demands. The decision marks a crucial moment in the advocacy for linguistic rights within the Indian judicial system, particularly in Tamil Nadu. The case will be reviewed for compliance on 06.03.2024.
