The Aryavarth Express New Delhi: The Saket Court has issued summons to Bina Modi and senior advocate Lalit Bhasin in a case filed by her son, businessman Samir Modi, relating to an alleged assault at GPI offices in Jasola in 2024. The court took cognisance of the charge sheet filed by Delhi Police, despite the police stating there was insufficient evidence to proceed against them.

Judicial Magistrate First Class (JMFC) Aneeza Bishnoi, while summoning the accused, observed that “after perusal of the chargesheet, statements recorded during investigation, and material on record, there exists sufficient material indicating their prima facie involvement in the alleged offence.” The court noted that at the stage of taking cognisance, a detailed evaluation of evidence is not required, and the circumstantial evidence forms a prima facie case to proceed with trial. The next hearing has been scheduled for May 7, 2026.

The case arose from an FIR lodged by Samir Modi at Sarita Vihar police station, alleging that on May 30, 2024, he was physically assaulted while trying to attend a board meeting at GPI, where he serves as Executive Director. According to the complaint, Surendra Prasad, the personal security officer (PSO) of Bina Modi, allegedly blocked him from entering the boardroom, pushed him, and assaulted him, breaking his right-hand index finger. Samir Modi claimed that two other PSOs were present as backup, and he feared for his life during the attack.

The Delhi Police had earlier filed a chargesheet on March 1, 2025, listing Surendra Prasad as the primary accused under Sections 325/341 Cr.P.C., while Bina Modi and Lalit Bhasin were included in column 12, citing insufficient evidence against them. Samir Modi later filed a protest petition seeking cognisance against Bina Modi and Lalit Bhasin, which the court allowed, noting that the Investigating Officer cannot unilaterally decide the involvement of accused persons.

Advocates Siddharth Yadav, Saurabh Ahuja, Rahul Sambhar, and Kashish Ahuja appeared for Samir Modi, while senior advocate Manu Sharma represented the accused.

The court emphasized that the summons are based on prima facie evidence in the charge sheet and supporting documents, and the trial will determine the extent of the accused’s involvement.
